Terms of Service (English)
Thank you very much for using the services provided by Astolab (hereinafter, “we/our/us”) (hereinafter, “the Service”).
Users are kindly requested to follow the Terms of Use when using the Service.
The official text of these Terms of Use is Japanese, and their establishment, effectiveness, and interpretation shall be governed by Japanese law.
User registration
User registration will be completed when we approve an application for registration by an applicant. We may not approve an application for registration if we judge it inappropriate; for example, the applicant violated the Terms of Use in the past. We will not disclose reasons for rejection.
Management of user name
Users should manage their user names and passwords for the Service under their responsibility. Do not let others know your password to protect your user name.
Users must not assign or lend their user names or passwords to a third party. If a combination of a user name with a password corresponds to the registered data in logging in, we will regard it as being used by the user who registered the user name. If you find unauthorized use of your user name, promptly report to us.
Use of the Service
Users must not commit wrongdoing in use of the Service, for example, destroying or disturbing functions of our servers/networks. If we judge any act of a user a wrongdoing, we may restrict the user’s use of the Service or terminate the user’s registration without prior notice. In this case, we shall bear no liability for any damages the user incurs arising from the restricted use and the like.
Charge and payment
Users shall pay to us the charge that we define and display on the website in exchange for the use of the Service, by the methods specified by us. We will not refund the usage charge for any reason once we receive it.
Protection of personal information
Our privacy policy describes how we handle users’ personal information. Prior to use of the Service, you must agree that we use users’ personal information in accordance with the privacy policy.
Discontinuation of the Service
We may discontinue or halt the provision of the Service without prior notice to users if we judge it is difficult to provide the Service, for example, when carrying out maintenance and inspection or updating the computer system relating to the Service. We accept no liability for disadvantage or damage a user or a third party incurs arising the discontinued or halted provision of the Service irrespective of the reason.
Disclaimer of Warranties and Limitation of Liability
We pay reasonable attention when providing the Service. However, we do not guarantee that there are no factual or legal defects in the Service (including deficiencies relating to safety, reliability, accuracy, integrity, efficacy, compatibility with specific purposes, security; errors; bugs; infringement of rights).
We bear no liability for any damages users incur through the Service except in cases of intentional or gross negligence. Even if we are legally liable, we bear no liability for damages arising from special circumstances.
Prohibited matter
Users must not engage in the following acts when using this service.
- Acts that violate laws or public order and morals
- Acts related to criminal acts
- Acts that destroy or interfere with the functions of servers or networks of our company, other users of this service, or third parties
- Acts that may interfere with the operation of our services
- Acts of collecting or accumulating personal information, etc. about other users
- Acts of making or attempting unauthorized access
- Impersonating another user
- Acts that directly or indirectly provide benefits to antisocial forces in connection with our services.
- Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, and other rights or interests of the Company, other users of the Service, or third parties.
- Acts of posting or transmitting content on this service that includes or is determined by the Company to include the following expressions:
- excessively violent expressions
- sexually explicit expressions
- Expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc.
- Expressions that induce or encourage suicide, self-harm, or drug abuse
- Other expressions that include anti-social content and cause discomfort to others
- Actions that our company determines are aimed at or aimed at:
- Sales, advertising, advertising, solicitation, and other acts for profit-making purposes (excluding those approved by our company).
- Acts aimed at sexual acts or obscene acts
- Acts aimed at meeting or socializing with strangers of the opposite sex
- Acts aimed at harassing or slandering other users
- Acts that aim to cause disadvantage, damage, or discomfort to the Company, other users of the Service, or third parties.
- Other acts of using this service for purposes different from the intended purpose of use of this service.
- Solicitation to religious activities or religious groups
- Other acts that our company deems inappropriate.
Text and images generated by this service may be used freely within the scope of the user’s own responsibility. We assume no responsibility for the use of generated content.
Copyright
Users may only use this service to post, upload, or input information such as text, images, videos, etc. that they own the necessary intellectual property rights, such as copyrights, or have obtained permission from the necessary rights holders. It shall be possible to do so.
The copyright of texts, images, videos, etc. generated, posted or uploaded by users using this service shall be reserved by the user or other existing rights holders. However, the Company may use the texts, images, videos, etc. generated, posted, or uploaded using this Service to the extent necessary for improving the Service, correcting deficiencies, and publicizing the Service. Users shall not exercise their moral rights regarding this use.
Except for what is provided for in the main text of the preceding paragraph, all copyrights and other intellectual property rights regarding this service and all information related to this service belong to the Company or the right holder who has authorized the use of the same to the Company, and the user may not use the service without permission. You may not copy, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for commercial purposes.
Changes in details of the Service and/or Terms of Use
Due to continuous changes and improvements of the Service, we may delete posted data, change details or conditions of use of the Service, or discontinue the provision of the Service without notice to users. We shall bear no liability for damage the user incurs arising from any of the cases above.
We reserve the right to modify the Terms of Use without requiring individual user consent in the following cases
(1) If the modification of the Terms of Use conforms to the general interest of the users.
(2) If the modification of the Terms of Use is not contrary to the purpose of this agreement , and it is reasonable in light of the necessity of the modification, reasonableness of the modified content, and other circumstances pertaining to the modification.
When modifying the Terms of Use, we will notify users in advance of the modification, the contents of the modified Terms of Service, and the effective date of the modification.
Notice or contact
We give notice to and make contact with users by methods specified by us.
Governing law and jurisdiction
The interpretation of the terms is governed by laws of Japan.
In the event of any disputes arising from the Service, Tokyo District Court or Tokyo Summary Court shall have an agreed exclusive jurisdiction.
If you are a resident of the United States, these Terms contain a binding arbitration clause and a class action waiver that affect your rights regarding how disputes are resolved. If you reside in the United States, you agree that any disputes between you and us shall be resolved by binding, individual arbitration and you waive any right to participate in a class action lawsuit or collective arbitration.

Astolab（以下、「当社」といいます。）が提供するアプリ（以下、「本サービス」といいます。）をご利用いただきありがとうございます。
ユーザーの皆さま（以下、「ユーザー」といいます。）には、本規約に従って、本サービスをご利用いただきます。
本利用規約は日本語を正文とし、その成立、効力発生、解釈にあたっては日本法を準拠法とします。
ユーザー登録
希望者からの登録申請を当社が承認することでユーザー登録が完了します。当社は、本規約に違反したことがある方からの申請である場合など、ユーザー登録を相当でないと判断した場合には、登録申請を承認しないことがあり、その理由については開示しません。
ユーザー名およびパスワードの管理
ユーザーは、自己の責任で、本サービスのユーザー名とパスワードを管理してください。ユーザー名を保護するため、パスワードは他人に知らせないでください。
また、ユーザーは、いかなる場合にも、ユーザー名とパスワードを第三者に譲渡したり貸与したりすることはできません。当社は、ユーザー名とパスワードの組み合わせが登録情報と一致してログインされた場合には、そのユーザー名を登録しているユーザー自身による利用とみなします。ユーザー名が不正に利用されていることに気付いた場合には、すみやかに当社へ報告してください。
本サービスのご利用
ユーザーは、本サービスのご利用にあたって、不正な行為をしないでください。たとえば、当社のサーバーやネットワークの機能を破壊したり妨害するような行為をしてはなりません。当社は、ユーザーの行為を不正行為と判断した場合には、事前の通知なく、ユーザーに対して本サービスの利用を制限したり、またはユーザー登録を抹消することがあります。当社は、この利用制限などによりユーザーに生じた一切の損害について責任を負いません。
料金及び支払方法
ユーザーは、本サービス利用の対価として、当社が定めた利用料金を、当社が指定する方法により当社に支払うものとし、当社は、いったん受領した利用料金は、返金を承っておりません。
個人情報の保護
当社のプライバシーポリシーでは、当社におけるユーザーの個人情報の取り扱いについて記載しています。ユーザーには、当社がこのプライバシーポリシーに従ってユーザーの個人情報を利用することに同意のうえで、本サービスを利用して頂きます。
本サービスの提供の停止
当社は、本サービスにかかるコンピュータシステムの保守点検または更新を行う場合など、本サービスの提供が困難と判断した場合には、ユーザーに事前に通知することなく本サービスの提供を停止または中断することがあります。当社は、本サービスの提供の停止または中断により、ユーザーまたは第三者が被ったいかなる不利益または損害についても、理由を問わず責任を負いません。
保証の否認と責任の制限
当社は、合理的な注意を払ったうえで本サービスを提供していますが、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます。）がないことを保証するものではありません。
また、当社は、本サービスによってユーザーに生じたあらゆる損害について、当社に故意又は重過失がある場合を除き、一切の責任を負いません。当社が法律上責任を負う場合であっても、当社は、ユーザーに生じた損害のうち特別な事情から生じた損害について一切の責任を負いません。
サービス内容や利用規約の変更
当社は、常に本サービスの変更および改善を行っていますので、ユーザーに通知することなく、投稿データを削除したり、本サービスの内容や利用条件を変更したり、本サービスの提供を中止することがあります。当社は、これらによってユーザーに生じた損害について一切の責任を負いません。
当社は以下の場合には、ユーザーの個別の同意を要せず、本規約を変更することができるものとします。
(1)本規約の変更がユーザーの一般の利益に適合するとき。
(2)本規約の変更が本サービス利用契約の目的に反せず、かつ、変更の必要性、変更後の内容の相当性その他の変更に係る事情に照らして合理的なものであるとき。
当社はユーザーに対し、本規約の変更にあたり、事前に、本規約を変更する旨及び変更後の本規約の内容並びにその効力発生時期を通知します。
禁止事項
ユーザーは，本サービスの利用にあたり，以下の行為をしてはなりません。
- 法令または公序良俗に違反する行為
- 犯罪行為に関連する行為
- 当社，本サービスの他のユーザー，または第三者のサーバーまたはネットワークの機能を破壊したり，妨害したりする行為
- 当社のサービスの運営を妨害するおそれのある行為
- 他のユーザーに関する個人情報等を収集または蓄積する行為
- 不正アクセスをし，またはこれを試みる行為
- 他のユーザーに成りすます行為
- 当社のサービスに関連して，反社会的勢力に対して直接または間接に利益を供与する行為
- 当社，本サービスの他のユーザーまたは第三者の知的財産権，肖像権，プライバシー，名誉その他の権利または利益を侵害する行為
以下の表現を含み，または含むと当社が判断する内容を本サービス上に投稿し，または送信する行為
- 過度に暴力的な表現
- 露骨な性的表現
- 人種，国籍，信条，性別，社会的身分，門地等による差別につながる表現
- 自殺，自傷行為，薬物乱用を誘引または助長する表現
- その他反社会的な内容を含み他人に不快感を与える表現
以下を目的とし，または目的とすると当社が判断する行為
- 営業，宣伝，広告，勧誘，その他営利を目的とする行為（当社の認めたものを除きます。）
- 性行為やわいせつな行為を目的とする行為
- 面識のない異性との出会いや交際を目的とする行為
- 他のユーザーに対する嫌がらせや誹謗中傷を目的とする行為
- 当社，本サービスの他のユーザー，または第三者に不利益，損害または不快感を与えることを目的とする行為
- その他本サービスが予定している利用目的と異なる目的で本サービスを利用する行為
- 宗教活動または宗教団体への勧誘行為
- その他，当社が不適切と判断する行為
本サービスで生成した文章や画像は、私的利用・商用利用を問わず、利用者の自己責任の範囲内においてご自由にお使いいただけます、サービスの利用を明記する必要はありません。当社は、 生成されたコンテンツを利用したことにおいて一切の責任や、 賠償責任を持ちません。
著作権
ユーザーは自ら著作権等の必要な知的財産権を有するか、または必要な権利者の許諾を得た文章、画像や映像等の情報に関してのみ、本サービスを利用し、投稿ないしアップロード及び入力することができるものとします。
ユーザーが本サービスを利用して生成や投稿ないしアップロードした文章、画像、映像等の著作権については、当該ユーザーその他既存の権利者に留保されるものとします。ただし、当社は、本サービスを利用して生成・投稿ないしアップロードされた文章、画像、映像等について，本サービスの改良、または不備の是正等ならびに、本サービスの周知宣伝等に必要な範囲で利用できるものとし、ユーザーは、この利用に関して、著作者人格権を行使しないものとします。
前項本文の定めるものを除き、本サービスおよび本サービスに関連する一切の情報についての著作権およびその他の知的財産権はすべて当社または当社にその利用を許諾した権利者に帰属し、ユーザーは無断で複製，譲渡，貸与，翻訳，改変，転載，公衆送信（送信可能化を含みます。），伝送，配布，出版，営業使用等をしてはならないものとします。
通知または連絡
ユーザーと当社との間の通知または連絡は、当社の定める方法によって行います。
準拠法と裁判管轄
本規約の解釈にあたっては、日本法を準拠法とします。
本サービスに関して紛争が生じた場合には、千葉地方裁判所又は千葉簡易裁判所を専属的合意管轄とします。
アメリカ合衆国居住者は、本規約には拘束力のある仲裁に関する条項および集団訴訟の放棄が含まれ、紛争解決の方法に関するあなたの権利に影響します。アメリカ合衆国にお住まいの場合は、ユーザーと当社に起こるいずれの紛争についても、拘束力のある、個々の仲裁によって解決するものとし、集団訴訟または集団的な仲裁に参加する権利の放棄に同意いただくものとします。
